re-assessment EHCP

I am going to be asking the LA for a re assessment of ds's education, health and care needs. Do I have to 'persuade' them do they often refuse?

I believe they have 15 days to respond after receiving my request. I am guessing that time frames may not be followed.

Can I appeal B,F and I and request re assessment at the same time?

LAs do sometimes refuse. They also often try to get away with failing to stick to the timescales, but you can enforce them if necessary. You can request a reassessment of needs as well as appealing. However, if possible, you would be better getting independent assessments while appealing. Assessments undertaken during the reassessment of needs may not be any better than the current ones.

I am on the waiting list for independent ep she hasn't given me exact date but will be September time, she has said she will let me know if there are cancellations. I am worried about ds even engaging.

I am a little further a long with ds appeal its registered however by the time ep has seen him it will be very late evidence (too late maybe) LA agree he needs ss and are looking to consult independent ss (I found this out today). I don't know whether to prioritise dd for independent ep.

A little different for dd they think mainstream can meet need. I received mediation cert a couple of days ago so I am pulling everything together to send off with send35.

Both of them have had ehcps for a while and neither are accurate. Needs have changed considerably for both.

You would be surprised how much an EP can gather even if DC struggle to engage. When is the hearing for DS?

As well as independent EP, have you considered whether SALT &/or OT are required? If you can’t afford assessments for both DC and you aren’t eligible for legal aid, Parents in Need can sometimes help.

Hearing is March next year, I am going to ask for expedited hearing I am waiting for LA's reply.
I can't get legal aid but I will have a look into the other. I was going for ep as would cover all roughly and make recommendations for provision?? SALT and OT are needed provision wise.
He had a very dedicated 1-1 when he 'coped' in mainstream she would spend a lot of time working on what was recommended by SALT as did I at home.

In that case, a September EP assessment won’t be too late.
