I am appealing B,F and I, I haven't received any updates since sending SEND35 and evidence. It was only a couple of weeks ago. When I decided to appeal I was under the impression that the LA were not in agreement of ds needing ss (caseworker had told me the wrong information) anyway all the ss responses are a full thing (8:62) should I just be appealing I for now as its a quicker route I have heard? wait till review for the rest if changes are not made then appeal later.

Just appealing section I is quicker because they are being prioritised, but it is risky because section I is the logical conclusion of B&F. If they are inadequate you risk your preferred placement not being named. What are B&F like? If the LA now agree SS is needed have they amended section I to reflect this? You haven’t heard from SENDIST because it has only been a couple of weeks. Appeals are taking longer to register.

They have named his current mainstream.. but agree ss. I pm'd you a couple of days ago so thanks for that. I am unhappy with B&F however they reflect that he needs ss as the LA agree and have consulted however ss is not named.
He is out of school currently.

If the LA agree SS is required they need to amend the EHCP. Do you have their opinion in writing? The quotes in your PM are very vague. They wouldn’t on their own indicate SS. Before dropping B&F I would wait to see the outcome of requesting an expedited hearing as per your other thread.

The decision letter is not clear however have been told that ss is agreed. I will complete SEND7 and see what date they come back with? I did not send all of F but it is all along a similar line. Unclear and not an accurate description of provision needed.

Going forward follow up verbal conversations with emails so you have a paper trail. That way if the LA e.g. say they acknowledge SS is required you have evidence they said it. If that is their opinion they need to amend the EHCP.

Don’t forget to seek the LA’s views before submitting a SEND7 to SENDIST.

I was very confused as to why they named mainstream when they agree special school for him, I had asked about this they just said I should exercise my right to appeal if dont agree. I am making sure I have a paper trail. Many thanks for advice.
