EHCP Review Documents missing

Has anyone else had difficulty getting statements before review and the review draft afterwards? We thought there were timelines to keep to ie statements to be sent 2 weeks before and review draft 10 working days after. In our GC's case parent hasn't received anything and school are not responding to requests. It's the first review. Happy with school but think parent should complain soon if nothing is sent. Now just under 2 months after review.

You can see the legal AR timescales here. If the LA propose to amend the EHCP, a draft must be sent out within 4 weeks, not 10 working days. LAs sometimes fail to adhere to them unless forced.

However, having read your other threads, there is far more to the story than you have posted here. Your ex-son in law needs to speak to the LA and apply to the court.

Have looked at the site you linked to and elsewhere and still think the ehcp paperwork is missing. In practice have other people always had copies of people's input prior to review & a copy from SENCO of report sent to LA? Have tried to get child's father to ask again for them & if no success, phone/email LA. Keeping a close eye on what's happening at school is important as well as the separate issue of access. Thanks for your points.

As I posted, LAs sometimes fail to adhere to the timescales unless forced.

The reason I mentioned the wider context is because it isn’t as simple as your OP makes out. Court can deal with educational matters as well as physical contact, but if ex-SIL won’t do that then you can’t force him.

We hope SIL gets a response from school and LA and the ehcp paperwork.
We take your point about the LA but would have thought he'd have got stuff from school / senco before & after review. Review itself seems odd with mum not being there and he wasn't told about her contribution or stuff in sen teacher's statement. He didn't ask why she wasn't there. He says a number of people were at the meeting and it seemed thorough to him. We talked to other GP who said SIL needs to confirm that the meeting was the actual review - but we don't see how school would have risked keeping him out of it. He was sent paperwork to fill in before review.
We understand that he can take things further in terms of the ehcp and clearly court is needed re access. Thanks your information is v useful - it's good to lnow what happens in practice as well as theory as it's all new to us and with the added access problems, not straightforward..
