decline ehcp

Hi , my child has been declined an ehcp , the nursery felt they would require one for school , so applied and have been declined . my child is 3 and a half . non/preverbal , limited interaction skills / limited understanding of language / complex sensory needs / struggles with transitions / no sense of dange / eats non edible items ect ... on waiting list for nuro-disability .

this is the reason for them rejecting .

After careful consideration, the Panel recommended that based upon the evidence provided, it did not
support the need to undertake an assessment of ... education, health and care needs because panel would like to consider the EHCNA next year when closer to school age.

where do i go from here ? where do i stand ? do i appeal or ?

Yes, appeal. The majority of appeals are upheld and the reason the LA has given isn’t lawful. Nor is it valid, DS needs an EHCP now, not just for school.
