EHCP mediation

I just wanted to share a positive story. Today I had my son's mediation with the LA, and the desicion was over turned - they have agreed to asses him!!

Initially they denied for him to have an assessment due to lack of evidence. I was advised many times on here to not attend mediation, and get the certificate to go straight to the tribunal - as the LA use this as a delay tactic. I am so glad I went with my gut instincts, and still attended it as they will now assess him.

I just wanted to say keep fighting! You will be heard - we are their voice!!

hi hun that’s so refreshing to hear I have mediation for my daughter tomorrow she has autism and adhd do you have any advice?

Thanks for the positive story. I have mediation for an EHCNA refusal soon too. My gut instinct is to give it a go rather than join the longer waiting list for a tribunal. I’m not convinced that it’s a delaying tactic.

I was asked to speak a little about my DC, I was a brutally honest as I can be, laid it on thick for the LA to understand he isn't a typical 3 year old and has major delays and significant needs. To be honest, they denied the EHCP due to lack of evidence. The school was very helpful, and we gathered 3 more reports for the LA.

I was not impressed the person representing the LA, they were late, didn't read all the reports and done this during the mediation and didn't know he was in nursery - very unprofessional. I didn't say much as I had the school senco with me - she done most of the talking and explained my DC's needs professionally. Good luck for tomorrow!

@BananaPie this was my attitude too! I was not about to wait for the tribunal - which can take a year! Sometimes you have to go with your gut, I was advised many times not to do mediation but I wanted to look the LA in the eye, and lay it on thick for them to understand the depth of his needs. Good luck, we are their voice - you've got this!! 👍🏽

The school are Saying they can meet her needs but they didn’t notice she had autism and adhd we weren’t private…. They aren’t giving her and educational support even Tho her last report she had fallen way behind school hasn’t realised…: we have the mediation attending and school and la

Let your evidence speak for itself, do you have an educational psychologist report for DD? go by what they advise and emphasise on what they say her needs are, because if the LA decide to assess her they will bring in their own EP to assess her needs

Yes she’s been diagnosed with autism and adhd

The only support they are giving is mental health support

@Holllymum so great to hear good news. I have Mediation today for my DD who is 15 and diagnosed with Autism,ADHD, Dyspraxia, Anxiety and PTSD. She's been turned down for an EHPC twice and hasn't been in mainstream school ifor 22 months. Mediation felt like the right way to go. Wish me luck!

Well the mediation meeting lasted 40 minutes and the decision was overturned!

The attendee from the LA EHCP team couldn't understand why DD had been turned down in the first place!

Ours got refused as there wasn’t enough evidence … gutted

She’s been diagnosed in October privately as school kept saying she was fine currently having a seiss assessment and kams are involved

No worries, if you google it you should be able to find EP's who helps write supporting letters for the EHCP application

My child was given a no to assess and I wanted to get it turned around as quickly as possible so I agreed for mediation. I wish I hadn’t. Cancelled first date an hour or less before due to start and now cancelled new proposed date which is this week and proposed a new date in almost 4 weeks time!! I’ve asked to appeal to tribunal! Disgusting delay tactic!
