Hi I have mediation on Wednesday with the LA, can someone please tell me what will happen on the day? I'm nervous as I don't want to mess this up for my DC, thanks

During the meeting you will be able to state why the LA’s decision is wrong and ask questions. They will state why they think the decision isn’t incorrect.

I would email the LA to make sure they are sending a representative with decision making authority. They are supposed to, but many don’t which makes the whole thing pointless.

@SearchingForSolitude

Thank you for the information, I will definitely find out. So I contact the LA directly or the mediator?

Contact the LA.

@rsih91 would you mind sharing how it went please? I have this in 2 weeks time

rsih91 · 03/03/2024 22:39

@Arthurnewyorkcity it was really positive, they overturned their decision and decided to asses for the EHCP.

My evidence spoke for itself and the school really helped to build a strong case

@rsih91 that's great to hear, very pleased for you. Mine is to discuss our sons school placement, we want specialist and again I think the evidence speaks for itself

@Arthurnewyorkcity according to your other thread, you have a JADR hearing coming up, which isn’t the same as the mediation the OP has posted about.

Arthurnewyorkcity · 04/03/2024 19:05

@SearchingForSolitude I thought it was the same thing just worded differently, I guess that goes to show how little I know! Thank you for pointing it out. Its definitely jadr

Mediation prior to submitting an appeal isn’t the same thing as JADR. Mediation before you submit an appeal is via a mediation company. JADR is via SENDIST and led by a judge.

You would have been given the option of mediation before you appealed, although mediation/getting the certificate wasn’t mandatory because you only appealed section I.

It is worth reading IPSEA and SOSSEN’s websites if you haven’t already.
