Really need help

My 15 year old (y11) has been having difficulties going into school from yr5.

They have a room in the school for pupils to access if they are finding school hard (refusal etc).

She has been under this room for 2 years now, and on a reduced timetable for around 3 years.
The school has supported her really well but really can not do anything else.

We do think she has undiagnosed sen (maybe ASD) and the school did put a EHCP request in but that was refused and we have put in for tribunal.

The ASD pathway was also refused saying it was SEMH she has already seen cahms that was a 2 year wait to then be referred to another organisation which made no difference as she wouldn't talk.
And they want her to see CAHMS again! Which if they do see her is another 2 years which we do not have!

She is now in crisis, is totally refusing to go to school full stop.
Hates her life,not eating,feels a like its no point as she is so far behind.
I just do not know what to do, if I take her out of school what support can I access?
Can I still get an EHCP?

Don’t deregister and EHE. It is often easier, although not easy, to get support when you remain in the system. Crudely, you are someone’s problem at the moment. If you EHE it is easier for professionals to sweep DD’s needs under the carpet, and they will say you are making suitable alternative arrangements. But if DD remains on roll, the LA retain responsibility. That doesn’t mean she has to attend if she isn’t able to.

If DD can’t attend school full-time the LA must ensure she receives a suitable full time education. This is separate to the EHCP process and should have become as soon as it was clear 15 days would be missed. Email the Director of Children’s Services requesting provision under s19 of The Education Act 1996. If you are ignored or the LA delay or refuse come back and you will be advised what to do next,

Yes, you can still get an EHCP. Is it a refusal to assess appeal or a refusal to issue? Inform SENDIST DD is out of full time education, you can request the hearing is expedited.

Thank you so much for replying, it is refusal to assess.

I will keep her on roll, the school have been very supportive but this is no longer sustainable and her mental health is in tatters and I can't bear to see her like this any more.
