School not giving extra help

My ds who has autism is in main steam school, mostly doing OK but is struggling with learning and needs extra help. He was having small group sessions to help him. But this year since September has been a nightmare with teachers off sick and leaving currently only have 50% of classes have teachers rest are all supply. So the ta who would have taken the sessions have been in other classes and has now just left! He then didn't receive any as the were focusing on year 6 Sat's. But as the school is getting extra funding for him due to sen, do I have a right to complain and find out where the extra money is being spent?

When you say the school receive extra funding for DS does he have an EHCP or is the school receiving high needs top up funding for him?

If DS has an EHCP the provision detailed, specified and quantified in F must be provided. If it isn’t you can enforce it, via judicial review if necessary. Email the Director of Children’s Services as it is them who is ultimately responsible for ensuring the provision is provided. However, if the provision is vague and woolly with wording such as “access to”, “would benefit from”, “or equivalent”… it is unenforceable and you should focus on tightening the wording up.

If DS doesn’t have an EHCP but the school are receiving high needs top up funding you should request an EHCNA as although the school must make their best endeavours to meet a pupil’s SEN an EHCP is the only way to guarantee and enforce specific support.

If your child does not have an EHCP then the school receives no specific and ring-fenced funding for them.
