Probably stupid question about applying for an EHCP...

My DC has a diagnosis ADHD and has also been referred to the Social Communication Pathway for an ASC diagnosis. They attend a school in the LA where we also currently live, however we are about to move house. Even though the new house is just across the road and my DC will remain at their current school, our home will be in a new LA.

My questions are:

  1. Do we apply for an EHCP to the LA that we live in, or the LA that the school is in?
  2. If the second, do we wait until we have moved to the new LA before beginning an application, or start it now with the hope of transferring it across to the new LA? Is there any advantage to this or just extra paperwork?

Thank you in advance for any insight – am at the very start of the process and am reeling from everything that needs to be understood!

You apply to the LA you live in.

How soon will the house move be? If you move LA with an EHCP the new LA will review the EHCP and potentially amend, reassess or cease to maintain. If you move LA during an EHCNA the new LA will decide whether to carry out an EHCNA and issue an EHCP, taking into account the old LA already decided to assess and any information gathered.

Thank you @JustKeepBuilding this is really helpful. The move is imminent and so it seems sensible to wait and apply direct with the new LA.
