Child not allowed in school

my dc receives 2:1 at all times. Due to staffing issues, over the last 4 weeks, we have had calls to say dc isn’t able to come to school! These calls are often first thing in the morning as we are on route to school! In 4 weeks, there’s probably been 2 days which haven’t been affected!

Ive spoken to our sen case worker at County, and also SENDIASS. Both have told me they’re escalating the case. But in the meantime, dc is still at home! If she gets to go to school, she’s isolated from peers to enable the staffing ratio to be met!

Any ideas on my next step?? She’s a teen that’s had considerable knocks to her education through health issues..and now she feels a burden to school also.

What the school are doing is illegally excluding DD. Inform the school DD will be attending full time unless they formally exclude her.

Is the 2:1 specified and quantified in DD’s EHCP? If so, it must be provided. Remind the school of that and also email the LA’s Director of Children’s Services informing them of the situation and reminding them they are ultimately responsible for ensuring DD receives the provision in the EHCP and if this persists you will begin judicial review proceedings. Then if it continues contact SOSSEN for help with a pre-action letter.

Yes it’s specified and quantified. Dc needs 2:1 at all times.

At one point the school told me that I’d need to do lunchtime supervision for dc! I refused obviously so they managed to cover it. But now they are making the school day a hideous and isolating experience for dc in order to facilitate staffing needs.

If I keep dc at home it means it helps school with their staffing crisis and I’ve been the one to make that decision. If I continue to send dc to school on the days they can ‘cover’, dc is left feeling a burden and lonely. In a room with 2:1 for the entire day and no other students!!

On the other days, dc is not even allowed into school.

I told the head that she was basically ripping up every equality policy going, she replied telling ME I was unfair!!

On the days DC does attend if DC has 2:1 in a separate room why can’t they have 2:1 in class?

Inform the HT you will be beginning a disability discrimination case if they continue.

One member of staff hasn’t felt up to attending a class situation due to health reasons, so dc has therefore been pulled out

That isn’t acceptable. You really need to email the LA’s Director of Children’s Services informing then of the situation and threatening judicial review. Then contacting SOSSEN if that doesn’t work.
