Named school on EHCP

If a child's current school applies for an EHCP for them - can a different school ultimately be named if the application is successful? The change would not be on the basis of ability to meet need rather on the basis of wanting a smaller school with better pastoral care.

Yes, the EHCP can name a different school. When you get the draft EHCP you get to name your preference and there unless the school is wholly independent the LA must name your preference unless they can prove:
-The setting is unsuitable for the age, ability, aptitude or special educational needs (“SEN”) of the child or young person; or
-The attendance of the child or young person would be incompatible with the provision of efficient education for others; or
-The attendance of the child or young person would be incompatible with the efficient use of resources.

I would add that parents have a right to mainstream (subject to the above tests) but not a specific mainstream school. Your request would be assessed on its merits as per the above tests. If it was found that attendance at the requested mainstream school failed the test, but the school that the child currently attends is suitable, the latter school could be named.
