School not using Soundfield system

Following a recommendation from the teacher of the deaf dd’s school installed a soundfield system but the teachers don’t use it. I have asked that they do, but they don’t. I have asked the senco to make sure it is used but he doesn’t. What can I do? The TOD has discharged DD but still thinks the Soundfield system should be used.

Ask the school for their complaints procedure ?
Write / email formally, asking why they are not using it, so you have their reply on record ?

Formally complain in writing, if that gets you nowhere consider a disability discrimination claim.

It would be worth getting back in touch with the TOD. Does DD have an EHCP? If so if it is included in section F complain to the LA and threaten Judicial Review.

No ehcp. The Tod told me she didn’t believe the school were using the Soundfield system but that she had to be careful what she said. I am nervous about making a complaint as I may need the school’s support for an out of cohort transfer to secondary. But I can see that I will probably have to complain.

Ask the Heateacher, in writing and copying in the Lead Teacher of the Deaf/ Head of Sensory Support at the Local Authority, why your DD does not have access to the Soundfield system provided to support her needs.

It doesn’t matter that she doesn’t have an EHCP, she has a disability covered by the Equality Act and the school has to make Reasonable Adjustments. They will be hard-pressed to argue that using a system that is already in the school (so no cost to them) and which will also benefit the other children in the classroom is not reasonable.

Make it clear what you want them to do, ie start using the Soundfield system, (arranging for it to be move to the correct classroom and staff to be trained if necessary), and to let you know by such-a-date that this has happened. If they don’t then implement it’s use, get a copy of the school complaints procedure and follow it step by step.

My reason for asking about an EHCP was because if DD did have one and the Soundfield system was specified and quantified in section F the quickest way to ensure it is provided would be Judicial Review proceedings.

How old is your dd ?
Is she able to reliably tell you that it isn't used?
I'm a bit puzzled by you saying the ToD said "she didn't believe the school were using the Soundfield system" rather than any other way of knowing this.

Her teacher all last year didn’t use it and the Tod would have spoken to dd and also the school
And reached her own conclusions
