EHCP issues

Hi - what do you do if the LA sends a copy of an EHCP to the wrong school? The wrong school then phone me clueless as to why they received this document. When I questioned the LA they claim no data breach because all children deserve a chance at mainstream within their catchment are. I chose a mainstream in our catchment area! So I questioned again and the second excuse was that there was confusion due to my son’s age and EHCP procedure?! None of this makes sense but it seems like a data breach. Any advice out there? Should I be seeking legal advice here? Tbh the LA have left me at the end of my tether with the whole process but just wondered if I’m wasting my time and should let it go?

I’m addition they sent my son’s report to a school where I know the staff and now they have been privy to my son’s personal information, which I am not happy about.

Check who is responsible for controlling information within the LA and make a formal complaint to them. The excuses they give are absolute nonsense. If they don't uphold the complaint, take it to the Information Commissioner. Be aware, however, that the ICO is quite slow as it's fairly inundated.

I have made two formal complaints, one because they forced the EHCP to the final stage in two days while my advocate was on leave and this wasn’t precise or quantified. The second was due to the EHCP going to the wrong school. I am seeking legal advice at this stage but I feel the LA have treated me like an absolute fool and if they were within their rights to do this I would rather know than making myself look even more foolish than I have been made to feel

You mean you were not given the statutory 15 days to consider the draft plan?
