ADHD and ODD in school

My 8 yr oldnephew was diagnosed with ADHD two years ago as well as a chromosomal abnormality which both his half brothers have (his dads side). Both of his brothers really struggled in education and unfortunately one is has been excluded from school and the eldest is estranged from his family. We also think he has ODD. These past 2 weeks he has been awful at school swearing (f word) hitting and refusing to do ANY work. The thing is he is bright and academically he is where he should be and above in some areas. He says the work is too hard but he refuses to do anything he doesn't want to do. Due to rudeness and pure uncompliance with school staff as well as hitting 4 children with a tennis racket at lunch time it was decided that he wouldn' t need to miss golden time today - which is the consequence for the other children if they don't comply. His two older brothers were never reprimanded for their actions at school and my SIL is sure that is why they have ended up the way they are. The main problem with him is that he is bright and he has cottoned on that if he throws a chair he is taken out of class to work 1-1 and then if he doesn't work he is bribed with a biscuit etc. He is horrible at home to my SIL and BIL and he blames her for not letting him stay home on the playstation all day. My BIL really stuggles with him as he feels he has failed his older boys. The SENCo and Head are having a meeting on Monday with my SIL and BIL to see what the best course of action is. Just wondered if anybody had any advice as what is the best course of action before he gets permanently excluded!!!
