School admissions

My son is undergoing an assessment because he may have Asperger's syndrome. There is a small village infant school which I think would be ideal for him, although it is usually over-subscribed and we may not be close enough for him to get a place automatically.

Alas the assessment will not be completed until after the deadline for our application. Does anybody know whether the LA will take account of a statement of special educational need made after the date?

Does your child already have a statement? Is the assessment for a diagnosis or is it a statutory assessment for a statement?

If he already has a statement then the school will have to offer your son a place, even if they are oversubscribed, unless that they can prove that it would be "incompatible with the efficient education of the other children" which would be very hard for them to prove, (and of course they may not even say no any way!) Unfortunately if he does not already have a statement then the school are not obliged to offer him a place, even if a Statutory Assessment is in progress.
