Autism and learning disability not considered an educational need - Proposed Amended statement

Help! Ds autism and associated ADHD and MLD are not mentioned in ds new ( proposed) statement in part 2 and 3. Is this right? ds is in year 6 so an amended statement has been issued ready transision. Its all a bit wishy washy and does not really reflect the findings of the statement review. I only have 3 days left to respond so very urgent!! Can't get through to IPSEA

I would post in SN: Children magso, but that doesn't sound right to me at all.

SEN Code of Practice:

"8:32 Part 2 of the statement should describe all the child?s learning difficulties identified during
the statutory assessment. It should also include a description of the child?s current
functioning ? what the child can and cannot do. The description in Part 2 should draw on
and may refer to the professional advice attached in the appendices. Where the LEA
adopt that advice in their description of the child?s learning difficulties, they should say
that they have done so. But merely stating that they are adopting the advice in the
appendices is not sufficient. The advice received may contain conflicting opinions or
opinions open to interpretation, which the LEA must resolve, giving reasons for the
conclusions they have reached. All advice must be considered and appended to the
statement. Part 2 should be set out in a fashion which can relate directly to the
description of provision set out in Part 3 (b)."

They are wrong.

You need to write to them rejecting the proposed statement as is, and insist that his Autism, ADHD and MLD are put in the correct sections of the statement.

Do the appenicies (the reports from the professionals) state them as educational difficulties?

What does the Ed Psych report say? Does it state that your DS had Autism, ADHD and MLD?

BTW the transition statement for secondary school in this area is done in Y5; the Y6 statement is very much a follow on document.

What have they actually written in Parts 2 and 3?.

Yes the statement review was in year 5, and this amended statement is based on it. The sen officer has been away (still is), and the HT has changed since the review and this is the first I have seen of it. The statement review says no changes are required (except in regard to transition) Unfortunatly ds first/ orignal statement was before ds was dxed with autism - we had several years wait for CAMHS - although the reports at the time all highlighted his autistic behaviour/ uneven profile/ etc. I have copied reports ( CAHMS/PAED/OT) to highlight the facts. Ds saw EP 4 years ago for original statment. Thank you again!
