Can I get a refund for this top?

Last week I bought a top from a sale rail in a small independent clothes shop. The owner said she was having a sale as she had new stock in so needed to shift the old stock. When I got it home, I noticed some damage on the neckline at the back. I went to the shop today to return it but, despite their Facebook page and website saying it was open, the shop was closed. I contacted the owner via email and explained the damage and attached photos. They replied saying that they knew the top was damaged and that was why it was reduced. I have asked for a refund but no answer. Due to work commitments and being away on holiday, I can't now go back to the shop for another 3 weeks. Am I right to say I should get a refund or, at least a credit note to buy something else? The owner did not mention the damage when I bought it. I have proof of purchase.

If the fault was not highlighted at the time as the reason then you are legally entitled to return it as faulty/damaged goods.

Thank you, that's what I thought. It was definitely not pointed out when I bought it, it was just referred to as old stock that she needed gone.
