advice needed, i feel like i am being fobbed off

i bought a phone for dh from the car phone warehouse on the 22 november to put away for christmas. on christmas day, it wouldnt accept either his or my vodaphone sim cards. i just thought it needed unlocking, but i have been to the store this morning and the shop girls tried thier sims in it (orange and o2) and it worked on thiers, still doesnt work on vodaphone.
they said it is our sim cards which are not right. mine was new on boxing day.
aparently the phone needs some newer software downloading on to it.
it is brand new fgs!
because its over 28 days since i bought it they wont give me my money back, or replace it.
so im stuck with a phone that is no use to us!
car phone warehouse said to ring vodaphone and explain the problem and get a new sim card.
what i dont understand is that mine is brand new and still doesnt work in it.
can i do anything? i feel like they are just fobbing me off, saying its our equipment thats wrong, not theirs.

Some phones are programmed to accept only certain sim cards. Clearly yours would accept Orange and O2, but not Vodaphone. Speak to Vodaphone who might be able to help, if you want to stay with them. Alternatively you could switch to Orange or O2.

a girl on the shop had a vodaphone sim card and hers worked.
they also said it was an 'open' phone so should accept all sim cards. i think i will have to ring vodaphone like you say.
i dont really understand as both our sims work in our usual phones.
