if tescos have got the price wrong thats their fault isnt it?

just been on tescos website looking at cakes for the dds christening and they've got MAD prices for their finest cakes!!! £2.99 for large choclate cake, £1.60 for finest st clements and cappucino cakes!!! can't be right can it? but if i order them today to be delivered in 10 days can they charge me full price? i can't really plead ignorance can i, and pretend i thought it was an great bargain because tescos are so WONDERFUL Grin? is there something legally binding?

They can charge you the proper price later. They state on their website that all prices are for guidance only. Plus prices in shops are merely what is known as an "invitation to treat", i.e. an offer for you to enter into a binding contract to buy. The contract isn't formed until you take the goods to the checkout and hand over your money. They can change the price at any time up to that point. Once they've taken your money, they can't then decide that the price is wrong.

The other day I order something that in my shopping basket was much cheaper thatn what it said on the website... and was billed the price on the website so... they can charge later, sometimes.

do you mean the small round finest cakes, the carrot, choc, ones? they are always this price, in store for me, great value for money and veyr tasty!

you will only get about 6/8 slices per cake they aint big!

once they have taken your money they can't change the price. i remember in B&Q once we bought some wallpaper took it to the checkout and the cashier said a higher price so i took them to where i had got it from. because they had advertised it at this price they had to sell me it at that price (but they did put a new price up pretty sharpish!!)

I brought a game for the PS2 for DS, it was priced on the shelf as £19.97 I was charged £29.99. I got a full refund and got to keep the game too.

when I worked in Boots we always had to charge the advertised price if there was a discrepancy - then (as you say) change the label sharpish! I'm sure this did lead to some people slyly moving labels about.

Legally, they don't have to sell you the goods at the incorrect price.

However, if they refuse they must also take immediate measures to remove the stock or correct the labelling.

I used to think shops were obliged to sell an item at the price it was marked up at. But apparently they can just decline to sell it to you and remove it from the shop floor.

If goods are priced wrongly, it is the shops own discretion if they sell it to you at that price or not.
I was at Tesco once and bought a 24 pack of coke and got charged the price on the box and not the cheaper price on the shelf. I went to customer services and on their board they say they refund the full price if they get it wrong, so i got all my money back. Think they've changed the board now .. Wink
