DS game not saving

We bought a copy of MarioKart for the DS from Ebay. It turned out to be a US version. It plays okay on a DS Lite but won't save progress. Is that an issue with US games, or is it more likely that the game is fake?

We have a US version for dslite and it saves fine. I know US ds games won't work on the ds xl, but thought they were fine on lites.
