SEN school appeal

Anyone have advice/experience please?

Sen school offer made, I have refused it as unsuitable.

I asked for ASD small school with little classes & non stimulating environment. Think 30 in the school.

We have been offered a school for learning & cognition, 500 + pupils, cluttered walls, strip lighting stimulating & engaging environment on a campus of 3 schools built together 5000 students. Traffic in/out awful.

I am being told I will now have to apply to appeal. I'd prefer to be in negotiation with the LA.

In wales. Any advice please?

It going to depend on what your reports say. If they dont support the type of school you want you're going to struggle without submitting you're own evidence/private reports that support your view.

Are there any “ middle ground” schools? A school that only has 30 must have several times that in children that it would be good for, but a 5000 pupil site seems to be vastly the other way!

If you are in England you get to name a school for the ehcp and the LA have to consult with them. That doesn't compell them to agree of course. Did you name aschool or have one in mind?

It's a completely different process in Wales...

To answer questions.

Yes in specialist primary with IDP.
Current class of 12 with 4 staff.
School agree its not the correct placement.
Yes lots of evidence saying needs ASD education both private & LA/NHS.

This is standard, you need to appeal the placement.

Bump for help please

I have found out that the small asd school told LA they couldn't meet need (and now I know the reason i agree).
The asd bases have told me my child isnt a suitable candidate as she can do minimal mainstream hours and the requirement is 40-50% hours.
So I have explored a local independent special school which sounds like they are suitable.

As I have to go to appeal do I have to only say why this school is appropriate
Or
Highlight why the offered school is unsuitable despite LA saying they can meet need.

It feels different to a regular appeal for a mainstream place so I do think I will have to justify why the offered schol wont work 🤔

As well as showing the independent school is appropriate/required, you should look to evidence why the ALP DS needs can’t be provided in the state school.
