i have put together a case to say council admitted error 37 days later- i have put case laws and shown precedent i have shown why the school is right. the council school admissions says they can withdraw - if the original error had not been made - we would not have got the place. so i am very very worried sick. but it really has taken a massive toll on us. he still thinks he is going there the alternative school now given us to with no discussion is past the 90 mins travel and inadequate on ofsted too. but if we had known on national offer day we would have at least had a chance for earlier appeals or and our remaining preferences
any others tips or help would be so so much appreciated

They are correct that you wouldn't have got the place but for the original error, but that is irrelevant. They cannot withdraw an offer after 37 days. That is far too long and potentially puts you and your son at a serious disadvantage. You should point out that you may have spent money on uniform, transport arrangements, etc. which is now wasted money - the council won't compensate you for any loss you have suffered due to their error. You should point out that the school they have now given you is an unreasonable distance from home (up to 75 minutes each way is regarded as reasonable) and is probably not the school your son would have got if they had not made the mistake, so he has been disadvantaged. And you should point out that the LGO case I referenced on the linked thread made it clear that withdrawing an offer made in error after 3 days or more was an abuse of power.

Thank you i really appreciate your comments in every way. the school place given to me was my number 2 original choice and it comes under a different council - i had made sure i was allowed to do this - manchester -it has no catchment- and his brother will be attending there for sixthform hence my reason for choosing it as my number 2. my number 1 and 3 are stockport council -
I have also appealed for my original 1 and 3 which are in stockport - and they suggested i do this. can i make a similar argument for these as well - i have school supporting letters on why he should be with friends and his anxiety but that may not be enough. in any case i do have the appeal for the withdrawn school on Thursday so everything crossed. I have filed my case and evidence - i have actually spent money / celebrated/ he told everyone of his friends etc but it is the stress that has been the worst.

stockport then one day ago now - suggested they will give me another school but equally poor and unsuitable for us but closer- so do i lose my distance argument i refused it and she said it will not impact my appeal but now in their case - mainly prejudice/ space over crowding they are saying we also offered the closer and it was refused.

they make it so hard and so tough - sorry if I'm rambling a lot
