EFSA Have ordered a fresh appeal

Hi

The EFSA have ordered a fresh appeal - will the new appeal panel know that this is a second appeal? Is it ok to mention as certain things have changed with my daughters health since the previous appeal ?

You mean the ESFA?
So, you had an unsuccessful appeal, you complained that they didn't follow due process, your complaint was upheld, and a new appeal was ordered?

If so, then it should be a completely separate appeal. The new panel won't know about the other appeal unless you or the school representative mentions it. But it might be appropriate to mention it if the panel asks questions about the timing of your appeal, e.g. "Why did you not appeal earlier?"

They also won't have the report pack from the original appeal, so rather than telling them what has changed you should present your case afresh as if the first appeal never happened.

Agree with the previous poster. Also, you don't have to present the same case at this appeal at all. You can present a completely different case if you want. Not saying you should, but you are not in any way constrained by what you did at the first appeal.
