I currently home educate my daughter 13 but I need her back into a secondary school now. She has a ehcp, she was home educated because she couldn’t cope in mainstream, my plan was to appeal when her annual review was due but unfortunately the LA has refused to do one ever since I home educated her so she’s been at home for far longer than planned and I now need her back into a school. My plan is to apply for a mainstream then get her moved onto a special school but she just needs to be back in the system basically. My questions are if she has an ehcp does that mean she can get into any school i apply for? If she is accepted into the mainstream school how soon can I do an annual review to get her moved or how soon can I apply to get her moved to a special school? Also do I need to do an annual review to get her back into a school again? I want to get her into a mainstream school then try to move her from there

Unfortunately they also never respond to emails or phone calls I’ve tried to contact them in the past.

Be careful with SENDIASS. Some are good, but too many repeat the LA’s unlawful policies. IPSEA and SOSSEN are far better for accurate information.

If DD has an EHCP, you can’t apply for a school place via the normal in year admissions process. You need a review of the EHCP. If the LA is in breach of its duty to carry out the AR, send the relevant model letter on IPSEA’s website to the LA. If that doesn’t work, you need a pre-action letter. SOSSEN can help with this but there is a wait so you may want to look elsewhere.

Alongside this, inform the LA in writing you are no longer EHE and they need to make arrangements to ensure DD receives a suitable full time education and anything detailed, specified and quantified in F of the EHCP.

Once you have had the AR, you will be able to appeal for a special school place if the LA refuse to name your preference.
