applying after appeal

My appeal was unsuccessful and a waiting list is held until December. Can I apply for a place again once waiting list has ended? or cant I apply for the same year group again?

I believe the waiting list “ending in December” just means that they wipe it clean and start again, but the only people on the new waiting list will be those who have requested to be on it. Lots of parents decide not to
move their child once they’re settled at a school so it’s a waste of office staff time to ring round a long wait list of everyone who had named their school as a higher preference to the one they got, but who don’t want to disrupt their child after they settled at the school they were given.
You can only appeal once in an academic year, so if you appealed for year 7 day, then I don’t believe you can appeal again until year 8 - but that would be an in-year appeal. I think that is set out by the Schools Admissions Code, so maybe check that out to be sure.

The school should say what happens after December 31st - they will probably maintain a Continuing Interest list, but are not obliged to. If they do, they may contact everyone on the waiting list towards the end of this term, to ask whether they want their DC to remain on the CI list - or they may expect parents to contact them and ask. Does it give any indication in the school's admissions policy? If there is a CI list and you ask for your DC's name to be kept on it, they will be ranked along with all the other DC on the list for that year group, should a place come up before the end of the academic year. So no further formal application required.

(The Admissions Code says: A parent can apply for a place for their child at any school, at any time.

At the same time, the School Admission Appeals Code says: Appellants do not have the right to a second appeal in respect of the same school for the same academic year unless, in exceptional circumstances, the admission authority has accepted a second application from the appellant because of a significant and material change in the circumstances of the parent, child or school but still refused admission).

Yes, you can apply again. You won't be able to appeal again if your application is unsuccessful.

Does that mean the waiting list is held with the council until December. It then gets passed to the schools to manage. That's what happens here.

Presumably you are already on the waiting list for now?

The school should tell you what happens when the list is disbanded; sometimes there is a list continued after they ask everyone to reconfirm (or not) their desire to stay on it, sometimes there is no list.

You can stay on the list at that point, or reapply if the list is disbanded. You can't appeal for the same year group again though unless there has been a significant change in circumstances.

They are not required to hold a waiting list after 31st December. If they genuinely don't, all you can do is keep applying and hope you are the first to apply when a place comes up.
