At the moment we are living in Spain, but will be moving back next summer, so I need to secure a Secondary School place for my daughter who will be going into year 7 on our return.

We will be living at a flat owned by my parents. Can we apply this October, from Spain, as we have the address where we'll live, or do I have to wait until we actually move back to the U.K. to do this? I'm not on the electric roll at the address, but my parents are.

You should be able to apply but you will need to find out whether they will accept your UK address for admissions or use your overseas one, in which case you will be likely to get an undersubscribed school.

You cannot use an address on your application that you do not reside in (and won't reside in until next summer) as that is fraudulent. You should either apply using your Spanish address and then when you come back next year update your address in the UK or simply apply when you come back next year.

Different rules may apply if you/your partner are working for the (British) Government.

You need to wait til you are back, or use your Spanish address, unless you are a crown servant family.

Ok, thank you.
