My child can't go to a school they've given him

I have a child whos been allocated a school that he can't go to as a perpetrator who he has a restraining on 4 children go there and we've been through 18 months of hell and he won in court against the abuser. We only.picked 1 school as he said he felt safe to go there and would.enjoy.school.once again ... the education welfare dont seem to care his life would be at risk if he attends the school and i have appealed to all local.schools but getting no where, I will end up home schooling him but I have a 4 month old baby and 2 brain tumours and work 12 hour.night shifts and I'm.not sure I can even do it but my child will be in danger And had threatened his own life if he has to go to that school with those children.... can any one give me any advise????

How flexible are you regarding other schools in the area? Only putting down one choice was probably the mistake- are you on the waiting list there though? I'd approach the LEA regarding safety concerns, but they may not necessarily allocate you the school you want, but a different one, would you accept that?

Did you preferred school have a critiera for exceptional circumstances? Did you apply under exceptional criteria? Did you provide evidence? Have you now formally applied and been rejected from all other schools nearby? Have you submitted appeal documentation to your preferred school? What about other schools in the area?

Can you appeal? I know of someone who had similar circumstances and appealed. Albeit it was for primary school but they were successful.

The mistake was only picking one school. I would ring ss for their support.

I don’t really get this-who has the restraining order? Against who? Who are the 4 children-is your child one of them?

Putting down only one school was probably a mistake. Have you been allocated your catchment school?

There is lots of movement in the first half term of secondary in my experience.

Yes I've put down all other schools and on a waiting list for all.schools I would drive miles just do he can go to a school and stay in education, he holds the restraining order against someone else....I've tried every avenue but educational welfare said it stands for.nothing even tho there are location restriction on the restraining order so.my.child cannot be approached .....I have provided evidence but they just don't seem to care, yes it was nieve of me.to only.put one school but it was the only.school sutible for.him and his choice. Finding i come up against brick walls each time i try n appeal

I don’t understand who has the restraining order and against whom? Is it the parent of a child at the new school?

without wanting to be a bitch here, putting just one school down and then complaining the "they just don't seem to care" when all the other schools you could have put are full is not reasonable at all.

Keep hammering away and he will get something else, but it may be inconvenient or not ideal for him.

Well, in theory then that’s the problem of the parent and as long as they’re not doing pick ups / drop offs I assume it wouldn’t legally break the restraining order?

Do you have a police liaison officer / social worker who might be able to help?

Where are you on the waiting lists for the other schools?
Have you checked the reason you didn't get preferred school - distance etc
Have you submitted an appeal for your preferred school - when is this likely to be heard?

I know what u are saying but there was several reasons why only 1 school was requested, but yes I appreciate it was a bad choice but from the outset it was stated why he needed to be in a school that was requested

So you put down one school, the one he wants, and he got it , bit now you are saying he can't use the spot as a parent he has a restraining order against has kids that go there?
Did I understand correctly?

No.i didn't put this school it wasn't a choice at all ....they gave him it as no places in any other school or the one he chose ....its ok i feel i shouldnt of asked for advuse as i see i should of.put more than 1 school ....I just wanted some advise that's all also thank u for comments

You can ask for advice, although you probably need to answer questions so people can advise you!

What were your grounds for appeal for the school you put down, and did this appeal fail?

What is the next closest school (except the allocated one) that has places?

I appealed with several reasons they have a great senco team and a small intake ect and the grounds of safety , I have appealed 3 times but it was a high birth rate year in 2007/2008 so yes hes been allocated catchment school which is big school with an even bigger year group, I have been and appealed to all 14 secondary schools but Its same story there full with huge waiting lists, and I've sat appeals with these schools and still.nothing....

Can I clarify when you say you've appealed do you mean you've submitted formal paperwork and then attended an appeal hearing?
Where are you on the waiting lists?

Yes I've done all the paperwork and appealed formally to.both schools and education Welfare.... I'm waiting on one more appeal , he's 179th on one, 6th on another and then he's in the 20s for the other 12 schools ..... I.know he's not the only child to not get into a school but most children. Don't have circumstances at 11 having been through a traumatic court case and just want to be kept safe

Have you asked where the closest school with places is? It may be some distance away, but would be an interim measure until a closer place comes up.

Also a good point on where he is on the waiting lists. There can be lots of movement before September, he may well get offered a place in the meantime.
