Age at start of secondary school in Scotland- help needed!

We have recently moved from London to Scotland (Aberdeen). DS (aged 12) completed Yr 7 in secondary school there and I am now having great difficulty deciding whether he should go into S1 or S2 and am getting conflicting information about whether I even get a say...
His birthday is end of January so he could go into S2 but he is quite immature for his age (also SEN issues) and if he had started school in Scotland I would have definitely chosen to defer entry until he was 5. I have been told that it is very common for parents of Jan/Feb children in this area to choose to defer. However, after initially saying that it should be possible, the school are now saying that he can't go into S1 and I have to appeal to the council. The council told me to discuss it with the school.
Does anyone know whether the right to defer for Jan/Feb children only applies at the very beginning of primary school or whenever you enter the system?
My February born DD was given the choice of starting in P3 or P4, implying that there is that choice.
I would be really grateful for any advice from anyone who has experience of transferring from England to Scotland during secondary school.
