My DC applied to a popular state school. They pride themselves on their over subscription rates Hmm

They have a scholarship entry where they award a set number of places on aptitude in three arts subjects. (Clearly stayed as ranked by aptitude deemed by a panel)

DC didn't get a scholarship.
They refused to give me the ranking. I'm sure this is not in keeping with admission code.

Is there a clause in admission code I can quote at them?

Basically they are now offering more scholarships to the admitted year group once they start at the school so perhaps they didn't fill their set number of places on the scholarship. Hence wanting to know where DC ranked.

No, I don't think you can ask them for 'the ranking', as such. If you are appealing (which isn't clear from your post) then they must give you any information which you reasonably request that forms part of your appeal. But they also have to protect the data of other pupils. So I would expect that all they would tell you is how many applicants for scholarship they received, what number your DC ranked at, and the number that the last admitted scholarship pupil ranked at. That should be enough to justify their position and help you decide/argue whether you have a point at appeal.

However if their criteria simply states that they will offer x places to scholarship students, and they did, they may have fulfilled their obligation. What they do after that may be open for interpretation. Who is to say that some of the children who got in under other criteria didn't also apply under scholarship and fail to get in under the scholarship route? I don't think you can assume that the school are acting badly here. I think you need a lot more information before you come to that conclusion.

They did rank the scholars. They won't give me my child's rank.

The Admissions Code only says that the school must take all reasonable steps to inform parents of the outcome of the aptitude test before the closing date for application so that parents can make an informed choice. That clearly requires them to tell you whether or not your child got a place on aptitude. It is less clear regarding ranking. I could argue it either way. On balance I think they should have told you the ranking as if there were, say, 20 applicants for 10 aptitude places, your decision as to whether or not to apply might have been affected by whether your child was ranked 11 or 20. But I'm hesitant about that. There is certainly nothing in the Admissions Code that requires them to tell you now, although a subject access request under the Data Protection Act might do the trick.

If you want a definitive ruling on this you will have to refer the school to the Schools Adjudicator.
