Hello - I have two children. The oldest is 10 and is moving to secondary school in September and younger child is 8. Both are in our local mainstream primary school. My youngest has Sen and has an EHCP issued last year. We have looked at secondary schools and the one we ranked first on our application we felt would work for both our children and ideally we are keen for them to go to the same school. Unfortunately my older child did not get a place and instead was given her second ranked school which although is good school would not be one that my younger child would be able to get to himself and the provision was not as good. We are on continuing interest list for the first rank school but unlikely to get it as are out of priority catchment and are quite far down the list for academic. Could we appeal on the basis that this school is best for both children or would they only consider my older child in isolation for an appeal. It was an important factor in our ranking this school as number one. Any thoughts would be appreciated

An appeal will hinge on showing that the detriment to him of not attending the school is higher than the detriment to the school of taking another pupil.

In reality, issues around being at the same school as his brother in 2,3? years time are very unlikely to be given much weight I'm afraid. Appeals can't be determined by what might happen in the future.

You need to make a wider case around subjects, clubs, specialisms this school has that suit your eldest.
