My ex and I are going through a nasty divorce and we are now at loggerheads as to who will have my DC. I want my DC with me as does he. Mediation hasn't helped and we are only civil in front of DC and at pick up/drop off. We are currently sharing custody 50/50

He's been threatening to apply for secondary schooling with his local authority which is 30 miles away. Can he do that? Can he and I apply for different authorities for the same child?

Please help without judgment.

I Know people who have done this (usually to get their child into a better school) but with both parents agreement - not sure about our situation where you disagree

Where did he go to primary and where are his friends going?

Which would your DC prefer?

No he can't do that without your permission. You need to either agree this one, thorough mediation if necessary or take it to court and let them decide where your child goes to school.

Sorry for my late reply.

My DC doesn't mind leaving the area to live with Dad but says she will be sad about leaving me. I think he wants to be told where to go.

GreenTulips, both areas have outstanding schools within 500m, so it's not really about getting DC into a better school.

I have been thinking long and hard about this and I will apply for schools in my area regardless.

My friend and her ex went to court to decide her son's secondary school preferences. They had to provide details of the schools, reasons why the schools would suit the son and also bus routes/train routes, costs etc. They had a 50/50 split but as she had more school nights and also got child benefit and CTC the application was made from her address.
