Anyone else getting the feeling that some people will treat the new hate crime legislation as a way to express their own hatred?

Anyone willing to take bets on how many times a day Tory MSPs get reported? Or how frequently Humza is reported?

Or how quickly the online reporting crashes due to volume?

It's going to be interesting to see how it all pans out.

Have a look at the latest Wings Over Scotland post - you'll need to do it this weekend though as it's closing, hopefully temporarily.

Rainbowshit · 29/03/2024 17:42

Hah. I wouldn't have believed 10 years ago I'd be agreeing with Wings. Or rather that Wings would turn so anti SNP...

Meanwhile the real issues that affect Scottish population are not dealt with and I can't be arsed to listen them as too numerous.

Northernsouloldies · 30/03/2024 01:15

List them.

butelass · 30/03/2024 10:01

It's deeply worrying. I have just today created a separate Twitter account to follow some of the more outspoken figures on both sides of the debate, as I don't even feel it's wise to have them on my follow list under my own name. I don't tweet but have always found it a useful place to be aware of the range of views outside your own circle.

Misthios · 30/03/2024 10:28

Yup, there are already some active accounts making lists of "terfs" to report on 1 April.

Restricting freedom of speech is really chilling. We already have crimes such as inciting racial hatred or posting homophobic abuse and threats to kill online. Nobody has the right to make threats or violence or death against any group online or face to face. But this legislation will make it a crime to say that you don't accept Isla Bryson as anything other than a woman.

Misthios · 30/03/2024 10:31

And also - the SNP will twist any sort of criticism against Humza Useless into some sort of racial or religious attack - we hate him because he's an Asian muslim man. Well no, we hate him because he is a useless nationalist tosser.

Northernnature · 30/03/2024 10:34

I doubt if hatred towards the English will be covered either, not accusing anyone here but there is no doubt an element of that in Scotland. Only certain "hate" counts which seems to be based on whether it's perceived by those with the most power whether the "hated" have power!

Misthios · 30/03/2024 10:40

I have an English DH and know what you mean. Perfectly OK to "hate" tories, terfs and the English.

334bu · 30/03/2024 10:47

Hating " terfs" is not a hate crime in Scotland as women are not covered by this bill.

So people aren't going to be reported under this legislation for tweeting (exxing?) that JK Rowling was absolutely right, or for saying that your biological sex is fixed before birth and can't be changed?

"Your name will go on Ze List!"

And no one is going 'are we the baddies?'

New law is unworkable in practice.

Misthios · 30/03/2024 11:12

I am thinking it will go in the way of the football speech legislation (or named person) which was introduced after lots of expense and amid much fanfare, and then had to be dropped as unworkable in practice. It's almost as if they have a track record of writing crap legislation.

Why do people keep voting for these numpties? They make the same mistakes over and over again with their ill thought out legislation. Although to be fair the alternatives aren't much better. I'd sweep the whole lot out of Holyrood and have a fresh start.

I also hadn't considered the football sectarian aspect, rangers and Celtic fans will also be drawing up their own list of people they hate that they want to report.

Well that's the million dollar question isn't it.

334bu · 30/03/2024 12:52

Sorry Mithios, I wasn't very clear. I wanted to say that the Scottish Government is quite happy to allow " hate" against "terfs" as they are only women and are not protected. Unfortunately, a woman stating the truth that no human being can change their biological sex is fair game for any misogynist out there.

Rainbowshit · 30/03/2024 13:34

So is belief not covered under the hate crime legislation? Just religious belief?

OP posts:
Misthios · 30/03/2024 14:15

I think under the Forstater ruling that you are legally protected in holding the belief that sex is binary and unchangeable. And that transwomen are in fact male.

But that legal protection won't stop the activists coming at you.

Rainbowshit · 30/03/2024 14:24

This is quite a good article.

archive.is/2024.03.30-111042/www.telegraph.co.uk/news/2024/03/30/scotland-hate-and-crime-act-orwellian-yousaf-snp-trans/

It seems you are allowed to express antipathy, dislike for or ridicule religion but not the other characteristics.

It's a mess.

I think I'll be feeling very hurt by people expressing antipathy to the middle aged come Monday.

IANAL, but Surely there is a conflict there with the article 10 rights of the human rights act?

I was wondering if I could report a hate crime on the basis of being English. Might have better luck as a cross dresser, as I usually wear jeans, hoodies and no makeup.

Because they can’t see past Independence as I see it.

I think you could legitimately say you think of it as racism. Or as you say adopt a trans identity.

Wings did a crowdfunder for legal advice, and the super Roddy Dunlop has worked over Easter to issue a legal opinion, reproduced in full on the above post, for all to read.
listened to the Today programme this morning, Peter Tatchell surprisingly against a lot of the Act, especially as it doesn't mention women (!). The SNP minister on after him was woolly brained as a sheep.
