I own a tenanted property in Scotland jointly with my brother.
If I was to buy out my brother's half, with the current tenants staying on, would I need to create a new tenancy for them - or just continue with the tenancy that we have?

Is it a private residential tenancy?

I don’t think you can continue with the same one - it would need to be amended at least to show the correct landlord name.

If that’s not possible you will need a new one. You can download them online , you don’t need a lawyer.

Remember you will also need to change the details on the landlord register.
