How long does it take to get an exclusion order and are they difficult to get?

Rented accommodation. He’s refusing to leave and I’m not leaving my home that I’ve had for long before he was around and everything I own. He doesn’t work so can’t afford to pay for it. Escalating emotional abuse and coercive control. He has recently sought treatment for opioid abuse.

Im in touch with WA and a domestic abuse team who are giving conflicting advice. One says if I leave even temporarily I lose all rights to the house. The other advised I change the locks which I don’t even think is legal.

If it's a rental then you need to speak to the landlord about changing locks, more importantly, is the tenancy in just your name or both?

The rental is in my name but I’m in Scotland so apparently he has as much right to be here as I do because we are married now. I need to get an exclusion order.

Contact your local Citizens Advise Bureau. They’re trained in housing matters.

Shelter have some info pages. scotland.shelter.org.uk/professional_resources/legal/relationship_breakdown/married_tenants/exclusion_orders
Scottish govt info www.gov.scot/publications/consultation-protective-orders-people-risk-domestic-abuse/pages/3/

I can’t find anywhere that says how long it takes. There are some pages by individual Scottish councils so maybe Google that and start with the council district you live in.
