Debt liability on separation

A woman I know separated from her husband as she found out he hit their sons as children and inappropriately abused their daughter. He got sent to prison for this. The children are adults now.

The husband has died but she has been given a care home bill for him. I have no idea who has given the care home her details. Would she be liable to pay his care home bill after all the family have been through? She has no savings. They are legally still married.

Did they have any joint assets? A property in joint names for example?

she definitely needs legal advice on this. Did she never want to get divorced? It might be if she’s been estranged for many years then she can refuse to pay it but she needs to seek advice from a solicitor. Really hope she doesn’t need to pay, guess you need to be careful if legally still married to someone

If there is no assets from the marriage she has no liability for the debt he has left. If the ex is still named on a property they jointly own, she could well be and needs to speak to a solicitor
