Does anyone know the answer to the following?

Parents of three children have split up. Ex-p has convinced the eldest to move in with him. After two years I had to contact csa as he refused to pay anything. He obviously gets a reduction for the eldest child living with him and now pays a minimum amount for the other two. He is now trying to make a claim via csa for the eldest child.

Its all about control; history of dv etc. I’d happily have the eldest with me but he’s tarnished her. I thought because he paid for two and had the reduction for one we were even as such but can he now claim against me also? Seems ridiculous as we will be sending back and fourth payments of similar amounts?

Yes he can make a claim against you for the one living with him. Unless each claim is assessed as the same amount of maintenance one will have to make a balancing payment to the other.

Yes he can ask you to pay maintenance for the child living with him. It works both ways. You’d get a discount for having other children to pay for like he gets a discount for having a child living with him.
