Child Maintenance and/or Mortgage payment

Currently separated and going through the divorce process.
ExH pays maintenance which I pay our mortgage, life insurance, home insurances etc out of and it leaves a little left over for me to pay some bills.
I was happy with this arrangement until he decided he was going to ‘keep’ the rental income from our second property even though I pay the mortgage for the rental (no profit at all, the rental income basically covers the mortgage amount) 🤯🤯
Where do I stand on this please? Speaking with my solicitor next week. Can’t wait to just sell both!

Stop paying the second mortgage, send him a message to say as you are now collecting the rent for the property, you are now responsible for the mortgage.

This is a tricky case because you are both jointly and severally liable for joint mortgages etc. Don't be tempted into the false economy of sorting it yourself to avoid legal bills. It is worth every penny to get a decent solicitor to put your foot down for you. It may take a bit of time but it never ceases to amaze me how entitled and gaslighting some parents are around money and their own family.

I would stop paying the mortgage on the rental.

Friend went through family court several years ago and not in uk as the other party wanted both child support and all mortgages paid, and had put caveats on 2 properties so couldn’t be sold. She (the other party) told the tenants she would be moving in, so they naturally left (so no rental income coming in).

Judge ordered caveats to be lifted and properties to be sold to discharge mortgages with child support payments maintained…
