Child maintenance fiasco WTAF!!

posting here for traffic

So based on yet again more false witness statements (usually hounded via SS from DC father - GM is one so knows which boxes to tick and language to use) the judge has decided that for the past 3 years I’m NRP and have to repayment anything from then. What’s even more galling is he states following a period of contact as per the court order, DC was full time with me - wanted no contact with the father. Judge knew this to be the case as he asked the CMS what would happen ie even though she was with me the case would fall away. My statement was ignored and factual inaccuracies submitted as evidence then further misquoted in the decision notice.

why would he do this knowing that not only would DC not get maintence but even when DC full time with me I’d be liable to repay.

context much DV involved over the years and I wasn’t allowed my Womansaid advocate present.

anyway had experience with ‘biased’ family court judges.

Sorry this is all jumbled as is my head 😱

So the mother of your ex works for cafcass & has coached your ex. And in a hearing they have managed to convince a judge that you have to pay him child maintenance even though the children live with you? That's shocking. Did you have a lawyer? Do you qualify for legal aid because of the DV? You should appeal, its time sensitive though, possibly as little as 7 days from the decision.

appealing but thank god it’s 30 days. I’ve years of social services false claims stress police restraining orders you name it.

they even went as far as to allude to sexual abuse at one point .

they never wanted the DC I say that as the grandmother who is a registered alcoholic is so full of vengeance because of how I view her son because of her behaviour they just wanted to derail and interfere in my life.

I met him when I was very vulnerable so that was the start of 19 years of hell I had hope when she past 18 the would drift away and have to recourse to interfere but low and behold and facilitated by a judge with an agenda - he knew what would happen even after stating there was a period of ‘shared care’ she had no more contact with her paternal family

i mean have we gone back to 1914 and I missed it?

I don't know if you can afford it but you need a Barrister to represent you who speaks the language of the court. The cheapest way is direct access:

There were malicious reports TO social services by the DCs father after he attacked me which came a week after he was arrested and released on bail. Along with an order to revoke my passport as my DC were at risk of abduction . ??? can’t make it up!

NOT that social services made false claims the false allegations were made TO SS. SS just followed due process and whilst that in itself leaves a lot to be desired the just did what they had to.

social services didn’t allude to anything it was part of the malicious report. False _= untrue statements. DC father alluded to there was some form of sexual abuse going on due to the content he included in this report ie the behaviour was such that there much have been an incident. That was another level of messed up I can’t even comprehend even now.

Obviously SS dismissed it all after the investigation as it became apparent it was malicious in nature. This went on for years to the point they refused DC a social worker when it was actually necessary.

notagamer yes, I do on this occasion the original contact case not so much, the process was more than fair and considered and the judge impartial and detached. CAFCASS were also fairly sensitive to the degree they can be. My rights during this time around have been denied and facts and statements deliberately omitted which is what I am taking issue with. There are factual inaccuracies in the court documents which change the entire context and so on. I’m shocked as it’s either incompetence, lack of care, of deliberate but any case involving children / DV and family matters should never ever been managed so sloppily.

registered on a treatment programme but the point is it’s not my OPINION that this person is a drunk as my opinion is irrelevant.
