Could this be seen as cheating?

So I am married but we have been living apart from each other for coming up a year. There was noone else involved, I was just unhappy and fell out of love.
But I have met someone that I like and if they were to ask me out, I would want to say yes.
Could this be viewed as cheating if I was to go out with him/sleep with him?

If you're both under the impression the marriage is dead then no why would it be cheating!

Are you separated? Living apart means you are no longer an active couple right? You have ended your relationship? You have agreed that you will divorce?

In which case, no. It's not cheating. Legally adultery perhaps. But in modern times not considered cheating.

Unless you are still agreed with each other that you are a couple and you're just having a bit of space but plan to continue the relationship.

Yes we are separated, as in living apart but technically still married. I didn't use the term separated as I thought that you have to be legally separated to use that term

No is isn’t cheating however I would just check that your spouse is absolutely in no doubt that you are no longer together. I only say this as a friend of mine separated, in her view it was a trial separation and she was very hurt when she found out her H was dating again.
