Going via courts

Hi all.

Just a question, has anyone ever had to go through the courts because other parent with PR doesn't consent to things like a) taking child on holiday or b) what school child should attend. I have a feeling my ex partner is going to be extremely difficult because he knows he can be.. So just trying to get my information together. Would be grateful to hear any experiences

Hi @Starfishcrazy, yes I have had to do that. I left my ex over four years ago, he battled me for 18 months and I ended up with a 50/50 order because I was too exhausted and worried about the kids being caught in the middle to keep fighting and I regret it ever since.

I had to have the order because he was constantly trying to control me around when he had the kids and changing things at last minute. I was struggling to keep to anything including childcare. He then kept the passports and would not give them back because he said I had been rude to him (he was very controlling then and now).

We have a court order now that outlines the rules such as advising on holiday dates, times of changeover, mothers and fathers day as well as birthdays, but he still uses anything he can to try and make it difficult. He admits he does this as he can't forgive me for leaving him and he will always make my life hell on purpose.

One thing that did help was asking for the 'live with' order. Even though I have 50/50 I have residence that means my address is what is used for all things such as school, doctor, passports etc. Its helped as much as it can with a nightmare ex so would recommend if you need a court order as I did make sure you get the live with bit.
