Child maintenance

Hello,
I'm having some problems with my children's father. He has a lovely life and is very successful and wealthy but very clever and not that nice, unfortunately. I've made a claim for child maintenance (the children are both small and not in school nor do I have child care so working for me just wouldn't work for now) to be paid legally and he had lied about how much he earns, alot is through dividend because he is the owner and director of a successful company. Has anyone else had this problem and what did they do?

Hi, not sure about dividends but i know bonuses and capital is not included as part if the child maintence calculations. I had this with my ex who only included his basic wage in the calculations and when i pushed i was told he was right not to include his bonuses. Then he got sacked and sued to a very large settlement. He was able to have a house extension, not work for a year, four holidays to America, but according to CMS he was earning nothing so wasnt liable to pay child maintenance... still baulks.

I know this doesnt bode well.If you know roughly what his monthly earnings are then go to the CHild maintenance calculator and get an estimate on what you think he should pay and got back with that and push.

Hubblestarr, dividends are not included in a standard initial calculation. You'll need to request a Mandatory Reconsideration (MR) if your calculation decision was less than 30 days ago or if over 30 days a variation for additional income.
Dividends can be included as unearned income.
