Child contact final hearing

Has anyone had a final hearing for child contact recently? How was it conducted? I have been told it will be remote but no details as yet. How did you converse with your solicitor? Mine is through submissions only and tabled for 3 hours.

Hi - I’m a family law barrister, and have participated in 2 final hearings in children matters since the pandemic started. Both were by telephone. It is also possible that the court would use a video platform like CVP or Skype for Business, but since it is submissions only (so no live evidence) I imagine they’ll stick to the phone. I usually set up an email chain with my client and solicitor, and keep my emails open at all times while the hearing is going on, so the client can quickly type a message if they need to let me know something/I’ve said something they want to correct. Solicitors have also suggested WhatsApp groups to me, but I would rather not give out my mobile number to clients!

Thanks for your replies. I'm really worrying now that it's getting closer. Statements have been filed and swapped already and will be heard by magistrates. I'm not sure what to expect at the hearing itself and how a decision will be made.

At the hearing itself, the magistrates will probably make some kind of opening statement. The applicant will then go first - you, or your ex. If you have a barrister, they will speak on your behalf (or your solicitor will) - making a speech setting out the dispute, what your position is, and why. The other side will get a turn, and the applicant typically gets a right of reply. The magistrates may then ask specific questions if there’s anything that needs to be clarified, before they retire to make their decision.

Since you are represented, it sounds like you don’t have to worry about anything - your solicitor or barrister will argue your case for you.

The decision they will make will take into all of account the evidence (including from CAFCASS or social services if applicable) and be based on what is in the best interests of the child(ren).
