How is child maintenance/spousal maintenance calculated?

I'm am getting a divorce. Basically I'd like to know if there's a percentage (or potential percentage range) of the ExH income I would be entitled to, to work out what it could potentially be.

I'm aware I need more legal advice but current solicitor is giving me no idea about potential maintenance amounts.

We have 2 DC. One is severely physically disabled, I have had to give up work to be a full time carer. We are not entitled to any disability benefits due to having been living abroad until recently despite being British.

you can work out child maintenance through the CMS calculator. I think it’s about 16% if income

In the U.K. spousal maintenance isn’t awarded very often. I suspect your situation will be more complex because of your child’s needs so you’d defiantly need advice on that but as a rule you’d be expected to find your own living via work or if not possible to work claim the relative benefits

I'm more interested in the total amount % of income including potential spousal maintenance which isn't included in the calculator. I'm aware it's probably not much but I'm wondering if I can get something even temporarily until I can put things in place to work again as I have no income.

You really need to get advice from your lawyer. If they’re not very illuminating might be worth getting a different one. Have you asked your ex what he’s thinking?

I don’t think there is a calculator for that because spousal maintenance isn’t really a thing in the U.K. it’s granted by the courts usually for specific circumstance. You’ll need your solicitor to advise you on the details.

If your husband won’t react a private agreement you would need to ask the courts to look into granting it with specific reason

I would work on ye a sunroom tho that you won’t be entitled so will have to look at ways to support yourself / find work

I get spousal maintenance as as does dp's exw. In both cases we worked it out privately and amicably. It's only awarded by the court in limited circumstances, marriages over 10 years with unequal incomes and the higher income earner must have substantial income. I receive £900 a month plus had enough money to buy outright from sale of family home. I have dc with sn (adult) so no cms.

I was bullied into a clean break so can't get anything and didn't get anything. Married over 15 years, he earns 3 times as much as me.

I'm trying to get him pay for our son, a monthly maintenance but he only forks up £200 and won't budge
