can you give my friend some wisdom

she lives with her partner at the moment in a council/housing asociation house

The relationship has broken down to a point where he wont let her get her hair done makes sure she has no money!!!

the house is in both there names but she has a child from a previous relationship who is happy at school

she has repeatedly asked him to leave but he refuses what would be he next step does she have the right to keep this house or him

if it is in joint names then she is probably stuck,what i would suggest she does is contact the HA and ask them if they have another property in the area she and her son could move to ,explain the situation to them , it would obviuosley be better if he left but it sounds like he is going to be a pain in the arse and sometimes its not worth the hassle .

(1) ask the Housing Association or council in confidence what her rights are
(2) ask about possibility of being rehoused in the same area - this might be easier than ejecting partner - and then dc can still go to same school.
(3) How does he make sure she has no money? If they have a joint account she can always stop putting money in it, and open a new account of her own. The child benefit should be hers.

so the HA cant ask him to move then as she is the ne with the child ad no job at the moment ??

she says she has asked the HA about a new house but they are all in really bad areas

thats all she gets CB and he makes her live of it completly food for her and child everyhing

If she is unemployed, is she not entitled to income support or similar?

Is she looking for a job?

I don't know if this would help cos I don't know your friends full situation, but I lived with an exp and our relationship broke down(he was abusive) and he wanted us out of the house but I had no where to go and had 3dc and was pregnant. He kicked me out and we slept at a friends hse. I spoke to a solicitor and we went to court in a matter of weeks and the court issued a order(god my minds gone blank on what its called) that told him that he had to leave the property and that I could reside there. The court sent the order to the landlord who had to comply. I then recieved HB and CTB for that property. Like I said I don't know if that will help, and if I remember the name or find the paper work I will post it on this thread.
