husband walked out -need to know

need to know this quickly - if a husband walks out on his wife and 4 children and the house is sold does the wife get 50/50 of the proceeds or is it more?

It should be more, don't know the exact legal stuff but AFAIK would definitely be more.

every case is different.
there may be other assets than the house taken into consideration.

A friend of mine got the house, her dh got everything else .

no, my lovely brother has walked out on my sister-in-law and his four children - really nice guy, eh? And we just need to work out her next step and we weren't sure if she's entitled to more than half the share of the house

Whatever the judge decides. Probably more if she's got to house the children. The judge will take all the circumstances into account. Get a good solicitor.

Hi Kibby.She will get AT LEAST 50% of the assets. My solicitor is going for 65% and I've only got 2 children. Give her my love. I know how shit it is.

Oh no, sounds like a terrible situation for you! It does depend on a LOT of factors and she should definitely get a solicitor ASAP but if she was caring for the kids and it came down to dividing the house proceeds without anything else being a factor, she should definitely get a larger share than him to look after the kids with. But in practicality it may be worked a different way, depending on other assets, maintenance, who has to live in the house etc. But any decent solicitor will make sure she gets a good deal, as she has to look after the kids and he only has himself to look after.

Go to ondivorce.co.uk - lots of people going through the same thing and loads of stories - one which may be able to help you.

She will get more then 50% most certainly and may even be able to secure a mesher order which means she will get to keep the house and live in it but when it is sold, she remarries or moves someone in she will have to pay him a certain amount.

Bloke on the above mentioned website has just been stung for all of house plus spousal maintenance plus half his pension - ouch!!
