Advice please?

Me and my husband have split up. He left on Weds. We have four children and 'our' home is a privately rented house.

He is now insisting on coming back here and forcing me to either stay with him or move out myself. I have no job, I have been a SAHM.

If he comes back I simply have nowhere to go and no options but to stay here as until I have a job I couldn't get a tenancy.

I really don't want this, I want this split to be as amicable as possible and share the care of the kids. I understand his frustration at leaving and having to start again but he's the one in a position to actually rent somewhere else.

Help?

Are you both named on the tenancy?

Have you seen a solicitor?

If you do have to move out, get yourself on the local authority housing list.

Yeah we're both on the tenancy. Nope not seen a solicitor, hoping it wouldn't come to all that for a while, that we could just amicably and informally separate.

You need to go to the CAB as soon as possible, and you could also ask for a free initial appointment with a solicitor to establish your rights.

I'm really sorry - sounds an awful situation. Whatever you do, do NOT agree to leave without the kids, even on the understanding you can collect them later. You could find he is then regarded as primary carer, if he later reneges on the deal.
