Divorce / house / new DP ....

Not sure if anyone can help. I split from my ex nearly 3 yrs ago. I have stayed in the house with my 2 DS's. We have a considerable amount of debt owed against the house.

I have a new partner and he would like to buy my ex's half of the house so we can finalise the divorce and move on.

I'm not sure if anyone knows but here goes anyway - will mortgage co's / secured loan co transfer the debt from me and ex to me and DP as the deeds are transferred or is it not that simple?

Also by having a new DP at the time of financial settlement will it weaken my case in court?

I have been in significant financial trouble for the last yr or so which means we wouldn't be able to get a joint mortgage under normal circumstances.

Any experience or wisdom greatly received.

Would need to talk to mortgage company to see if they will transfer the mortgage to your DP and DH will need to agree to transfer his share of the property to DP. DP will need to have have credit check salary checked etc to see if Mortgage company happy to transfer risk from Ex H to DP.

Your DP?s income may affect your financial Settlement if you move in together and live as husband and wife. Sharing the mortgage could indicate to the court that this is a serious relationship and they will take this into consideration for any maintenance you are seeking for your self. Maintenance for the children should not be affected but this would depend. Best bet is to see a solicitor who deals with family matters and property matters.
