Neighbour removing fence off my land

Looking for some advise please! I brought my house 9 years ago, the deeds to the house clearly show a straight line going from the mid point of the two houses (semi detached) to the full length of the garden. When i brought the house there was 4 fence panels which sit on the boundary and the rest of the fence panels are almost 1ft into my land.

All of the fence panels match the other 2 sides of my garden and the nice side is on my side all the way around, including the gravel boards.

My neighbour is now claiming she paid for the fence and is having it dug up! This fence which is very clearly almost 1 foot onto my land.

I have no idea what agreement was made with the previous owner and no proof she owns the fence but the deeds clearly show its my land.

Ive rang 101 who was useless and the best they said was ask her to build a new fence on her side but shes already told me this is happening wednesday wether I like it or not!

what can do?

You might want to put this on the legal board. If I was in your situation I would consult with a solicitor tomorrow and draft a strongly worked letter.

Agreed, legal up as soon as you can.

If any workmen come let them know this is your land and any fence on it is legally yours. Print out a copy of your title deeds to show them.

Thankyou, i didnt know how to move it so ive reposted it in legal. will speak to a solicitor tomorrow, its so underhanded how little notice she has given me!

Just because it's on your land doesn't mean you own the fence. It's whose paid for the fence. Neither does it depend on what side of the fence you are looking at (i.e. nice side or not). However, if she or the tradespeople enter your property that is trespassing although that's a civil matter and not criminal.

If the fence was encroaching on your land why didn't you raise the issue before? Wasn't this pointed out to you when you bought the house by your solicitor / didn't you raise it with the solicitor?

Ask her for proof of ownership of the fence. Copy the title deeds and give her the copy as well as the tradespeople. Send her a letter raising the dispute. Maybe speak to Citizens Advice?

Take photos /videos (before, during and after).

However, is this something you are prepared to go to court over?

Tell her the new fence needs to be built in her land not yours, and then you gain 1ft of garden.
