Chimney repointing & Party Wall Act

Does anyone have any experience of chimney repointing on a semi-detached house, and the Party Wall Act? We are about to have our chimney repointed (only our side) and someone said we should have an agreement under the Act.

The back story is that 18 months ago our party-wall neighbour had a huge amount of work done, removing a chimney breast. An Agreement was created under the Party Wall Act. There was some disagreement at the time and the relationship is now strained.

For repointing my view is you don't need to serve notice since what you are doing is a repair and doesn't involve cutting in or adding to the party wall.
But you'd be wise to consult a party wall surveyor and pay for their advice so you can rely on their insurance if there is any issue, especially if you have aggro with the neighbours already.

If your side needs pointing doesn't theirs? Seems odd to do half the job, can't you agree to do the whole thing and pay half each? It will be 'difficult' to decide where to stop cleaning out old pointing and replacing and could well lead to disagreements, 'you damaged some of their pointing' or even 'you damaged their side of the chimney' during the work.

Actually, looking at the Act I think this is probably right because of the reference to repairs in section 2(2)(b).
Don't ask the builder- my neighbours' builder said they didn't need to serve notice on us for a loft conversion including removal of a chimney breast etc! They'll be long gone if there is any issue.
