Hi I took the liberty of starting a new thread as I couldn't answer on the last one.

@kirinm I am glad you've decided I pull out. I wanted to suggest it but didn't want to stress you out. I hope the next house you view is the one and it all goes smoothly.

@ingkir I have just read all the search results. My son has helped with a couple of questions, I've left a message for my friend to help with something else and I am waiting for the solicitor to ring me back as they've attached someone else's details to the end of the paperwork 🙄. I'm distinctly unimpressed as of course potentially someone has mine and the whole stream could be wrong. Looking at what the emails say it is likely it is a one off but I needed to tell them. The receptionist was going to put me through to the solicitors secretary until I said why I was ringing. Already over the time of when she said she'd be back.

I still have a few things outstanding but I won't exchange until I have answers so I'll wait it out.

@Twiglets1 vendor currently has poa for her husband already as he's in a care home.
This is what we've been told by her EA.

Update I rang the estate agents this morning and I gave a deadline of Wednesday for things to be sorted by. I kind of need to know an answer about the windows before I renegotiate and they'd had that inquiry for four weeks now.
The estate agents tried to say oh this happens all the time and it's like it might happen all the time, but someone somewhere needs to be doing a lot more work to make the solicitor buck their ideas up

That’s as may be, but it these things shouldn’t happen, don’t happen to everybody and just because you’ve seen things happen, as a professional, you should remember that the people paying your fees are expecting you to discharge your duties efficiently and chase people if they don’t respond promptly. It’s all so stressful and is made more so by the attitudes of some of those who are supposed to be on the ball.

The estate agents have been particularly bad and I feel like they need to be on the phone to the Seller saying look can you put pressure on your Solicitors please? I can't believe they just kind of expect me to wait around until her solicitor is back from being off sick.

This is what we've been told by her EA.

You will only need Grant of Probate if the house is in his sole name. If the house is jointly owned as joint tenants then all you need is his death certificate, which takes days not months. Wife can sell solely.

If the house is owned jointly as tenants in common you still only need his death certificate and appoint a second trustee in the Transfer deed. Wife can still sell without grant of probate for him.

Please don’t listen to your estate agent. They all make it up as they go along. Speak with your legal adviser.

Had another update from the EA the seller didn't even know her solicitors was off sick the EA has had to tell her. Honestly, apparently she's also getting pressure from her chain to complete. If I was the seller, I would be asking to knock some money off because this is ridiculous.

Obviously I really hope he pulls through. I was in shock when the EA rang Friday afternoon and could barely utter a word.
Our buyers came round that evening as they were shell shocked too. At least we've clarified that they're committed to buying our house and we confirmed to them we weren't pulling out of selling to them. We can't!
We just feel helpless it being the weekend and can't talk to anyone.
I had a wry smile when you said about talking to our legal advisor. She didn't even ring me after we were told the news. Bearing in mind we were mid exchange when notified you'd think she'd have the courtesy to ring.

I can’t comment on the wide variety of conveyancers that are allowed to practice with minimal supervision….(although I’d bloody love to!).

Fingers crossed all goes well and it’s not needed, but it really shouldn’t delay things

The seller left the place in such a disgusting state as it's been empty for a while so think dead bugs in the carpet, weeds 6ft high (which werent like that on viewing) and random dirty objects left in the garage that we'll need to skip. Prick is making half a mil from his mothers estate and couldn't even be arsed to chuck the vacuum round - pissed me right off. We absolutely scrubbed the place we left until it was pristine so to have to do it all again on the new house was mentally and physically exhausting. Still - at least we are here and can start settling in.

Wishing everyone still in this awful inefficient process good news and exchanges and completions asap.

Congratulations!!! Sorry it was left in such a state but delighted to hear you are moved in 😊. Our turn on Thursday, still feels surreal, just filmed a tour of current house with the kids to help them process moving, will do another one with them in the new house too....

I've viewed it twice and its not sat well with me. I'm a freeholder current, service charges scare the living daylights out of me.

How old is the house? Not all leaseholds are born equal. There are loads of old houses in my town which are leasehold and a million miles away from the 'fleecehold' new builds.

Congrats @TheEnglishSystemSucks ! Sorry about double cleaning but the positive of that is you know you're starting clean.

Next week will be one of the most important of my life in terms of a home. Please can you all hold me up, send good vibes, cross everything as I've been in tears a lot and been unwell with the stress.

Also, sorry for starting the thread and being rubbish with advice and much support. I can't answer a lot of the questions so haven't attempted to.

We have reserved on our new build today, after a thorough appraisal of all alternative options. Some nice surprises in that the developer had thrown in 15k of incentives which we have chosen to use 50/50 for deposit contribution and options. House also has front landscaping and wardrobes which we weren't expecting.

On the negative side we have learned the rear garden will be on a slope 1:12 gradient and will have steps and a retaining wall with railing to partition the garden. As a positive it will have paved patio near to the house. I'm a bit twitched about drainage but will plant some thirsty plants behind the wall. We could look at getting it landscaped/tiered later if needs be. We have an L shaped garden so hoping I can add a patio at the top corner for a bit of extra sun.

Our build is due end of March for completion with a long stop of end of June. I'm hoping it stays to plan as we have FTB buying our current house, and I wouldn't want to push them further than April so we would have to look at temporary accommodation if the build over runs.

No word it's a 60s build, but service charges worry me. It's got 140 years but it's certainly not a forever home and there talk about additional fees for a sink fund for new windows. My hearts

That's good @TheCatCameBack112 that you have reserved as I recall you were wavering on whether to go new build. We didn't like the part ex figure they gave us - it was 5k underneath our bottom line so we asked for stamp duty and they said no! Confused so we are using the assisted move scheme. I hope the plot we want doesn't go in the meantime 🤦🏻‍♀️

Another week ahead. We should be exchanging Wednesday but it won’t be happening. Our buyers buyers are ftb fuckwits with useless solicitors. The behaviour from both of them is so ridiculous I can’t even tell you what they’ve done because it’s so outing! Completion for the following Monday will also be off cards now.

I am beside myself. I cannot carry on in this stress. I dream about it. That’s when I do sleep.

I regret the day I ever thought I’d “just have a little look on rightmove”

I am usually such a resilient person but this has pushed me to the actual edge.
